TERMS AND CONDITIONS (T&Cs) OF VEHICLE HIRE FROM TIDAN INVESTMENTS PTY LTD
trading as TIDAN TRUCK & CAR RENTALS (TTCR)
These basic Terms and Conditions make up wholly or part of Tidan Truck and Car
Rentals' contract with the renter. By selecting "I agree with Tidan Truck
Rentals Terms and Conditions", you as the renter also known as renter or
hirer, has effectively signed our online contract which has the same effect as
the site-signed contract. Tidan Truck & Car Rentals reserve the right to
request a site-signed contract and an onsite verification of your driver's
license. By accepting these terms and conditions, you agree that this form may
be used for future subsequent vehicle rentals without having to re-complete or
physically sign the form on site with each new hire effectively using the
previously agreed terms and conditions.
1. CONDITION OF VEHICLE: Tidan Truck & Car Rentals state that to the best
of our knowledge and belief that the vehicles we rent out are in sound and safe
condition and free of any known defects or faults which would affect its safe
operation under normal use. The vehicles are rented out with minor damages as
detailed on the photos captured by Tidan Truck Rentals prior to renting it out.
Any further damage will be fixed at the renter’s expense including paying
relevant insurance excess and admin fee within 7 days of incident. The Renter
shall keep the vehicle in a reasonably clean condition. A cleaning charge of
$80 shall apply for a dirty vehicle including night driving bug splatter. Tidan
Truck & Car Rentals might request an ad hoc inspection of vehicles for long
term rentals. Service may be denied at any time and if negligent behaviour is
noticed during rental, and full or partial bond may not be reimbursed. Tidan
Truck & Car Rentals' vehicles are fitted with vehicle surveillance and
monitoring equipment onboard the vehicle. Renter must not attempt to access or
temper with this or any part of our rented vehicle. In situations where damage
to our rented vehicle is determined to be intentional, the renter may face
criminal charges if excess is not paid up. Renter is also responsible for
damage caused by natural causes such as flooding as long the even happened
within their rental period.
2. RECORD OF VEHICLE CONDITION; Tidan Truck & Car Rentals will document the
external condition and any existing damage to the vehicle both prior to the
renter collecting the vehicle and upon its return. The renter agrees that they
are also responsible for taking their own photos of the vehicle at the pickup
location before driving, and again upon returning to the vehicle for comparison
in the event of damage. If damage is identified, images taken by Tidan Truck
& Car Rentals before and/or after the rental period will be compared with
those provided by the renter to determine liability. The bond may be processed
immediately or withheld following a basic post-return inspection. If a more
detailed inspection is conducted and damage is discovered thereafter, the
documented vehicle condition will still be used to determine
responsibility—even if this occurs several days after the rental period has
ended. Tidan Truck & Car Rentals may specifically request renter during
pick up and drop off to capture photos of the vehicle condition using their
mobile phone and upload them via the supplied website vehicle condition form
link.
3. STRICTLY NO SMOKING is permitted in the vehicle. While vehicle is in the
renter's possession, the renter will ensure that the vehicle in good working
order. If smoking is detected in the cab, a cleaning fee of up to $250 applies.
4. QUALIFICATIONS: The Renter is expected to be physically and legally qualified
to operate the above-described vehicle has a full driver's license (copy of
license to be supplied).
5. RENTAL PERIOD, FREE MILEAGE AND DROP OFF LOCATION: Rental Period is either
24 hours daily or on hourly basis within minimum period of 4 hours, mileage is
100km for short term rental, additional mileage is charged at $0.30/km. Pick up
and Drop off location is typically from the place designated by the office and
may change at TTCR's discretion. Only legal parking at vehicle drop off time is
acceptable. Tidan Truck & Car Rentals reserve the right to change pick up
and drop off location.
6. RENTAL RATE: The Renter is expected to pay the owner at the quoted amount.
All fees are paid upfront. Weekly rental fee is paid one week in advance.
7. INSURANCE, EXCESS AND ADMINSTRATION FEE: TTCR’s vehicles are insured,
however, in the event of accident, the Renter is liable for $4200.00 excess and
admin fee, irrespective of who is at fault. If someone else is at fault, renter
is liable for the $4200 fee to us and can then sue the offender for this
amount. The Renter also agrees that only the vehicle is covered under
insurance, and the driver or passengers are not covered. The Renter also agrees
that personal belongings and other items left in the vehicle at any time are
not covered. To reduce the excess and admin fee to $2400 payable by the renter
in case of an accident, the renter agrees to pay $50.00 if required. Renter
agrees that Tidan Truck & Car Rentals reserves the right to take the renter
to Small Claims Court to recover excess.
8. RETURN OF VEHICLE: The Renter is expected to return our vehicles to the
pickup location no later than the time and date of return. Additional Charge of
$50/hour will apply if agreed time is exceeded by at least one minute and any
additional mileage will be charged at 30 cents/km.
9. FAILURE TO PAY, RETURN
VEHICLE, AND VEHICLE RECOVERY: If the renter fails to return the
vehicle within the agreed timeframe or fails to pay for the service, requiring
Tidan Truck & Car Rentals to recover the vehicle, the renter hereby
authorises Tidan Truck & Car Rentals to remove all contents from the
vehicle and proceed with recovery at the renter’s expense. Should the renter
leave any personal belongings inside the vehicle, Tidan Truck & Car Rentals
reserves the right to empty and deliver such items to the renter’s premises
specified in the rental agreement, or place them in storage, with all
associated costs to be borne by the renter. The renter acknowledges that Tidan
Truck & Car Rentals is not liable for any damage or loss to personal
property left in the vehicle during recovery. The renter agrees to pay all
vehicle recovery costs and authorises Tidan Truck & Car Rentals to access
any property or premises where the vehicle is located for the purpose of
recovery. Such entry shall not be deemed trespassing in the event of
non-payment.
10. TERMINATION OF RENTAL AGREEMENT: The Lessee agrees to notify the Lessor in
writing of their intention to terminate this rental agreement at least one (1)
week prior to the desired termination date for all long-term rentals (seven
days or more rentals). An inspection of our vehicle will be made by our team at
that time. Failure to provide timely notice will result in the continuation of
the rental agreement under the same terms and conditions until the required
notice period is fulfilled and forfeiture of the bond amount paid. For
short-term rentals, after early returns, for the used remaining days, only half
of the amount is reimbursed, and this amount is subject to owner’s discretion
and is not guaranteed.
11. FUEL, TOLLS AND TRAFFIC INFRINGEMENTS: Any use of toll roads is to be
reported and paid by the Renter and is subject to a $25.00 admin fee or amount
determined by TTCR payable to Tidan Truck & Car Rentals. If renter
nominates to use their own e-toll tag, a $25.00 admin fee or fee determined by
TTCR applies and bond reimbursement may take up to 7 working days. The Renter
shall return the truck with the same level of fuel it was picked with, an admin
fee of $25 or amount determined by TTCR applies if vehicle return with
inadequate diesel fuel on top of the cost of fuel. Any traffic infringements
incurred by renter shall be reported to authorities and paid by renter. All
traffic fines will be subject to a $65.00/infringement admin fee or amount as
determined by TTCR.
12. EXCLUSIONS: The rented vehicle shall not be used to carry passengers or
property for hire. The rented vehicle shall not be used to carry passengers
other than in the interior or cab of the vehicle. No animals are allowed in the
cab of the vehicle. Additional Cleaning fee of $50 to remove pet furs will
apply. The rented vehicle shall not be used to push, propel or tow another
vehicle, trailer or any other thing without the written permission of the
Owner. The rented truck shall not be used for racing in any competition &or
any illegal purpose or operate the vehicle in a negligent manner. The rented
vehicle shall not be operated by any other person other than the Renter
stipulated in 1.2 above without the written permission of the Owner. If Renter allows
any other person to drive the rented vehicle and has not informed Tidan Truck
& Car Rentals, the Renter will be fully responsible for all expenses
relating to the rental car and any other vehicle involved in any type of
accident during the rental period.
13. LIABILITY FOR LOSSES DUE TO ILLEGAL OR NEGLIGENT USE: The Renter
acknowledges and agrees to be fully liable for any and all losses, damages,
fines, penalties, or expenses incurred by the Tidan Truck & Car Rentals as
a result of the Renter's use of the hired vehicle in a manner deemed illegal,
negligent, or in violation of applicable laws or the terms of this Agreement.
Such liability includes, but is not limited to, damages to the vehicle,
third-party property, personal injuries, legal fees, and any other associated
costs. The Renter shall indemnify and hold harmless the Tidan Truck & Car
Rentals (TTCR) from any claims or liabilities arising directly or indirectly
from such illegal or negligent use. This clause shall survive the termination
or expiration of this Agreement. The renter acknowledges and agrees that Tidan
Truck & Car Rentals may cooperate fully or partially with law enforcement
and third-party entities regarding any investigation or liability concerns that
arise during the period when the renter had possession of the rental vehicle.
The renter/renter further agrees to communicate with and directly reimburse
third-party entities seeking compensation for damages, losses, penalties,
fines, or expenses resulting from incidents involving the rental vehicle,
especially those not reported or where the excess has not been paid to TTCR. If
TTCR does not receive the required excess within the specified timeframe for
any third-party damages incurred during the rental period, the renter agrees to
be held liable for the associated damages, losses, and expenses.
14. DEPOSIT AND BOND: The Renter is further expected to pay the security
deposit amount (also known as bond) as stipulated by the Owner. The security
deposit will strictly be paid via credit card unless
authorised by Owner. The said deposit may be used, in the event of loss of or
damage to the vehicle or equipment during the term of this Vehicle Rental
Agreement, to defray fully or partially the cost of necessary repairs,
replacement and or insurance excess. In the absence of damage or loss, said
deposit shall be credited toward payment of the Rental Rate and any additional
balance shall be returned to the Renter within 5 business days.
15. CREDIT CARD PRE-AUTHORISATION AND TOP UP: A physical banking or credit card
may be requested upon arrival, and an initial hold of the bond equivalent may
be placed on the card. Additional charges for any extra expenses during the
rental period may also be deducted from the card. Once rental period is
complete, the block on the card may be released within 5 days to the Owner
whilst the renter is paid via bank transfer or Payid. The settlement time is
dependent on the renter's bank's transaction processing times. A top-up is used
to increase the value of the original pre-authorisation transaction, where the
expected value of the final transaction may be higher than the initial
pre-authorised amount in instances such as rental extension, Insurance Excess.
The expiry date of the original pre-authorisation transaction processed on a
Mastercard, Visa or Amex will also be extended. Transaction surcharges costs on
card will be paid by the renter.
16. FAILURE TO PAY EXCESS AND DEBT COLLECTON: If the Renter fails to pay the
required excess amount following an accident, damage, theft, or any other
incident where the excess is payable under the terms of this Agreement, the
Owner reserves the right to take all necessary steps to recover the outstanding
amount including approaching Small Claims Court. In the event that the excess amount
remains unpaid after a number of days from the date the payment was due, the
Owner may engage a third-party debt collection agency to recover the
outstanding balance and or approach Small Claims Court. The Hirer shall be
liable for all reasonable costs and expenses incurred by the Owner in
recovering the outstanding amount, including but not limited to, debt
collection agency fees, legal fees, and court costs. Interest will accrue on
the unpaid excess amount at a rate of 7.5% per annum, calculated daily from the
due date until the outstanding amount is paid in full. The Owner reserves the
right to report non-payment to relevant credit reporting agencies, which may
impact the Hirer's credit rating.
17. OPTIONAL EXTRAS: : We do offer optional moving accessories for a small fee
of $45/hire period or amount determined by the owner. Once rental period has
expired without returning these accessories or TTCR does not receive payment as
agreed, optional accessories will be charged as per daily rate of $45, effectively
from the time payment has not been received. Additional driver is charged at
$10/rental period.
18. ACCEPTABLE DRIVERS LICENSE: Australian Drivers Licenses are accepted. Green
Ps and Red Ps acceptable for drivers above 25 years old. Tidan Truck & Car
Rentals reserves the right to permit drivers under the age of 25 years of age
and any drivers under 25 years will compulsorily pay the $45 excess reduction
fee. Foreign Driver's License holders will need to provide valid credit card
details and valid proof of residence such as a utility bill. Additional drivers
may be added for an additional fee prescribed by TTCR.
19. LOST AND FOUND PROPERTY: The renter acknowledges and agrees that the rental
company shall not be held responsible for any property left in or on the rental
vehicle during or after the rental period. The renter is solely responsible for
ensuring that all personal items are removed from the vehicle before the
return. In the event that any items are left behind, the rental company makes
no guarantees regarding their recovery or safekeeping. The rental company is
not obligated to search for, retain, or replace any lost or forgotten property.
If any lost items are found, the rental company may, at its discretion, attempt
to contact the renter or return the property, but assumes no liability for any
loss or damage to the items.
20. INTERSTATE TRAVEL: Renter should inform the office and pay associated
interstate surcharges and mileage as prescribed by the office. Failure to
inform the Owner of any Interstate travel plans using Tidan Truck & Car
Rentals' vehicle may invalidate any support including Roadside Assistance and
Insurances. Furthermore, if Interstate travel is undertaken without declaring
it in the rental agreement form, the renter, agrees for Tidan Truck & Car
Rentals to remotely disable vehicle until the renter pays any outstanding fees
owed.
21. MECHANICAL MAINTENANCE & BREAKDOWN ASSISTANCE: All Tidan Truck &
Car Rentals vehicles are provided with 24-hour roadside assistance in case of
mechanical breakdowns that are not caused by the user. If you require
assistance while on the road, contact NRMA Roadside Assistance at 131122 for
prompt support. Please note that additional charges may apply if the breakdown
is due to user fault. Tidan Truck & Car Rentals assumes no responsibility
for any direct or indirect losses resulting from any mechanical hired-vehicle
breakdown. The Renter will NOT attempt to fix the rented vehicle even if they
are a qualified mechanic without contacting TTCR office. For long term rentals,
the renter must ensure that they bring the vehicle in for service, repairs,
assessments and inspections to the pick-up location at the time requested by
the office. TTCR is not obliged to supply a replacement vehicle when the vehicle
is brought for service, repairs, assessments and inspections and any other
reason requested by TTCR.
22. RENTER AT-FAULT ROADSIDE ASSISTANCE: If you require roadside assistance due
to renter-at-fault incident, a callout fee of $150 will be charged for each
request.
23. VEHICLE PICK-UP & DROP-OFF: TTCR provides a vehicle pick-up and
drop-off service for an additional fee, subject to availability. Please note
that fuel expenses are not included in this fee. No fuel top-up administration
charges apply. TTCR is not liable for any losses resulting from delayed pick-up
or drop-off. Renters are responsible for ensuring the vehicle is ready at the
agreed time; any delays will incur additional charges. Mileage charges apply
from the point of pick-up and continue until the vehicle is returned to the
same location.
24. NEGLIGENT USE OF VEHICLE:
Tidan Truck & Car Rentals vehicles are constantly monitored and may be
inspected without renter being made aware. Service may be denied at any time if
negligent handling of vehicle is observed during the client's rental period,
and full or partial bond may not be reimbursed in order to cover repair costs
incurred through negligent use of vehicle.
25. DIGITAL SIGNING OF CONTRACT: By selecting "I agree with Tidan Truck
Rentals Terms and Conditions," you hereby acknowledge and accept all terms
and conditions set forth by Tidan Truck & Car Rentals. These terms and
conditions shall constitute a binding and ongoing contractual agreement
governing each payment and rental cycle between you and Tidan Truck & Car
Rentals, without necessitating the execution of a new agreement, except as
requested by Tidan Truck & Car Rentals.
26. AGREEING TO THE TERMS AND CONDITIONS: By selecting "I agree with Tidan
Truck Rentals Terms and Conditions" on our Contractual Agreement Form,
you, as the renter, consent to electronically sign our online contract, which
carries the same legal validity as a physical signature pursuant to the
Electronic Transactions Act 1999. This agreement applies to both the current
rental and any future rentals initiated upon your possession of the vehicle or
subsequent payments for additional rental periods requested. Your selection
also pre-authorises Tidan Truck & Car Rentals to charge any outstanding
fees through our EFTPOS machine using the bank or transacting card you have provided,
covering all rental-related expenses, including any applicable excess charges
during your rental period. Tidan Truck & Car Rentals reserves the right to
require re-execution of this contract and verification of your driver's license
or proof of residence at the rental location.
